Privacy Policy
Last Updated: March 15, 2025
Thank you for choosing to use our web application and services ("ModView," "we," "our," or "us").
This Privacy Policy explains how we collect, use, and protect your personal data when you access
or use our services, including our TikTok Box Battle Score Tracker (the "Service"). It also outlines
your rights under applicable data protection laws, including the General Data Protection Regulation ("GDPR").
1. Data Controller
The data controller responsible for your personal data is the creator or operator of ModView
(collectively referred to as "we" or "us"), who can be contacted at jhancuff@modview.io.
2. Data We Collect
- Account & Login Information: When you use our Service, we collect certain
credentials, including your TikTok open_id (if you choose to sign in with TikTok) or your locally
created username and hashed password. We do not store any raw passwords from TikTok; only the
minimal tokens/cookies necessary to authenticate and operate our Service.
- User Content & Scores: We store data related to TikTok Box Battles (e.g.,
diamonds gifted, scoreboard updates, and multipliers) to facilitate real-time score tracking.
- Session & Usage Logs: We keep session information (e.g., session IDs,
timestamps, IP addresses) to maintain user sessions and for security audits (the "audit log").
- Subscription Tier Data: If you subscribe via TikTok to a particular Tier
to gain access to our Service, we may store a record of that subscription tier, your associated open_id, and
the date/time of subscription validation. We do not store credit card or financial
data, as all subscriptions are handled through TikTok's platform.
3. How We Use Your Data
- Service Operation: We use your login information and battle scores to
provide the real-time scoreboard functionality, track diamonds, and manage the hosting experience.
- Authentication & Security: We use session data and hashed passwords (for
local logins) or tokens (for TikTok-based logins) to verify user identity, prevent unauthorized
access, and detect or address technical or security issues.
- Compliance & Legal Obligations: We may process your data to comply with
legal obligations or respond to lawful requests (e.g., subpoenas or court orders).
4. Legal Basis for Processing (GDPR)
Under the GDPR, we rely on the following legal bases to process personal data from individuals
in the European Economic Area (EEA) or the United Kingdom:
- Contractual Necessity: We process your personal data to fulfill our
contractual obligations to you (e.g., providing scoreboard functionality and real-time updates).
- Legitimate Interests: We use data in ways that are necessary to maintain
and improve our Service, conduct analytics, ensure security, and protect against fraud.
- Consent: Where required by law, we may rely on your consent to process
certain personal data (e.g., optional sign-ins or marketing communications).
5. Data Retention
We retain your personal data only for as long as necessary to fulfill the purposes outlined in
this Privacy Policy, unless a longer retention period is required or permitted by law. For instance,
scoreboard data and session logs may be retained until the battle session concludes or until automatic
cleanup thresholds are reached. Audit logs may be stored longer for security and compliance reasons.
6. Data Sharing & Transfers
- Third-Party Services: We may share certain data with service providers or
subcontractors who assist us with hosting, database maintenance, analytics, and other support services.
We require these third parties to process your data on our behalf and in accordance with this Privacy Policy.
- Legal Disclosures: We may disclose data to law enforcement or regulatory
agencies if required by law or when we believe disclosure is necessary to protect our rights,
investigate fraud, or ensure user safety.
- International Transfers: If we transfer personal data outside the EEA or
UK, we ensure that appropriate safeguards, such as Standard Contractual Clauses, are in place to
protect your data.
7. Cookies & Tracking Technologies
We use session cookies and similar tracking technologies to keep you logged in and maintain the
real-time scoreboard feature. These cookies are essential for the Service and cannot be disabled
without impacting functionality. We do not use third-party advertising or behavioral analytics cookies.
8. Your Rights
If you are located in the EEA or UK, you have certain rights under data protection laws, including:
- The right to access, correct, or delete your personal data.
- The right to object to or restrict processing of your data.
- The right to data portability.
- The right to withdraw consent (where processing is based on consent) at any time, without affecting
the lawfulness of processing before withdrawal.
- The right to lodge a complaint with a supervisory authority.
To exercise these rights, please contact jhancuff@modview.io.
9. Data Security
We implement reasonable technical and organizational measures to protect personal data against
accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. However,
no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
10. Children's Privacy
We do not knowingly collect personal data from children under the age of 13 (or the age of
digital consent in your jurisdiction) without verifiable parental consent. If you become aware that
a child has provided us with personal data without parental consent, please contact us so we can
remove the information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Any changes will be reflected by the
"Last Updated" date at the top of this page. Your continued use of the Service after the posting
of any revisions indicates your acceptance of those changes.
12. Contact Us
If you have any questions, concerns, or requests regarding this Privacy Policy or our data
practices, please email us at jhancuff@modview.io.
